Welcome to FindALiftClub ("we," "our," or "us"), a community platform connecting private individuals for informal lift-sharing arrangements in South Africa. These Terms of Service ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Platform").
IMPORTANT LEGAL NOTICE
FindALiftClub is a community connector for informal lift-sharing between private individuals, NOT a commercial transport or e-hailing service. We do not provide transport services, facilitate payments, or verify users. All arrangements are between users.
By accessing or using FindALiftClub, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Platform.

Community Lift-Sharing Platform
FindALiftClub connects private individuals for informal lift-sharing arrangements, similar to traditional lift clubs or carpooling among neighbors and colleagues.
We provide a community platform for:
- Private individuals to share lift offers with route details, schedules, suggested cost contributions, and contact information
- Community members to find lift-sharing opportunities or post lift requests with cost contribution ranges
- Users to conduct due diligence and share safety experiences
- Participants to manage their offers and requests through secure token-based links
CRITICAL LEGAL DISCLAIMERS
- NOT a transport service: We do not provide transportation services or employ drivers
- NOT commercial e-hailing: This is informal cost-sharing between private individuals
- NO payment processing: All cost arrangements are made directly between users off-platform
- NO user verification: Users are responsible for their own due diligence and safety verification
- NO liability: We are not liable for user interactions, safety, or transport arrangements
2.1 Age and Legal Capacity
- You must be at least 18 years old to use our Platform
- You must have the legal capacity to enter into binding agreements
- You represent that all information provided is accurate and complete
2.2 Driver Responsibilities
As a driver using our Platform, you acknowledge and agree that:
- Licensing: You are solely responsible for ensuring you have all required licenses, permits, and registrations to provide ride-sharing services in South Africa
- Insurance: You must maintain appropriate vehicle insurance coverage for ride-sharing activities
- Vehicle Safety: Your vehicle must be roadworthy and comply with all applicable safety standards
- Legal Compliance: You must comply with all applicable transport laws and regulations in South Africa
- Cost Contributions: You may suggest cost contributions for shared expenses (fuel, tolls, parking) but this must be informal cost-sharing, not commercial profit
- NOT Commercial Operation: You must not operate as a commercial transport service requiring permits under South African transport law
- Accurate Information: You must provide accurate information about your routes, schedules, pricing, and availability
2.3 Passenger Responsibilities
As a passenger, you agree to:
- Provide accurate pickup and destination information
- Set realistic cost contribution ranges for lift requests
- Respect drivers' vehicle rules and preferences
- Arrange cost contributions directly with drivers off-platform as informal expense sharing
- Conduct yourself safely and respectfully during rides
2.4 General User Conduct
- Use the Platform lawfully and responsibly
- Not engage in fraudulent, harmful, or illegal activities
- Respect other users' privacy and safety
- Not misuse the safety reporting system
- Provide accurate information in all communications
3.1 Informal Lift-Sharing Community
What We Are:
- Community connector for informal lift-sharing arrangements
- Platform for private individuals to share transport costs
- Similar to traditional lift clubs or carpooling groups
- Communication facilitator between community members
What We Are NOT:
- Commercial transport or e-hailing service
- Taxi, ride-hailing, or public transport operator
- Payment processor or financial intermediary
- User verification or background check service
- Transport service provider or driver employer
- Insurance provider or safety guarantor
3.2 South African Transport Law Compliance
Legal Positioning: FindALiftClub operates as a community platform for informal lift-sharing arrangements between private individuals, similar to traditional lift clubs. This model is designed to fall outside the scope of commercial transport regulations under the National Land Transport Act, 2009, as we:
- Do not facilitate commercial "for reward" transport services
- Do not process payments or enforce fare structures
- Do not create contractual transport obligations
- Support informal cost-sharing arrangements only
3.2 User-Generated Content
- All offers and requests are created by users; safety reports are user posts in our Facebook group
- We do not verify the accuracy of user-generated content
- We do not endorse any specific driver, passenger, or ride arrangement
- Safety reports reflect individual user experiences and opinions posted on Facebook
3.3 No Warranty
We provide the Platform "AS IS" without warranties of any kind. We do not guarantee:
- The accuracy of user-provided information
- The reliability or safety of drivers or passengers
- The completion of arranged rides
- The resolution of disputes between users
4.1 Platform Liability
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW:
- NO LIABILITY FOR USER INTERACTIONS: We are not liable for any interactions, disputes, injuries, damages, or losses arising between drivers and passengers
- THIRD-PARTY SERVICES: We are not responsible for the actions, omissions, or negligence of drivers, passengers, or other third parties
- TRANSPORTATION INCIDENTS: We are not liable for accidents, injuries, property damage, or other incidents occurring during rides
- USER-GENERATED CONTENT: We are not responsible for the accuracy or consequences of safety reports or other user-generated content
4.2 Indemnification
You agree to indemnify and hold harmless FindALiftClub, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your interactions with other users
- Any transportation services arranged through the Platform
5.1 Purpose
- Help users make informed decisions about ride-sharing partners
- Allow users to share experiences for community benefit
- Provide a mechanism for due diligence
Safety reporting is hosted in our public Facebook group. Before traveling, search the group for existing reports. When posting, include clear evidence (e.g., screenshots, photos, receipts) and a factual description.
5.2 User Responsibilities
When submitting safety reports:
- Report honestly and in good faith
- Base reports on actual experiences
- Avoid false, malicious, or defamatory statements
- Respect others' privacy rights
5.3 Dispute Process
Reported individuals may dispute reports via comments/admins in the Facebook group, or by emailing us at communications@mail.findaliftclub.co.za. Please include counter-evidence where possible.
- Facebook group admins moderate and may remove content that violates group rules
- We may provide guidance or escalate disputes to admins but do not control Facebook moderation
- We may retain dispute-related communications as needed to resolve the matter
5.4 Content Expiration and Management
- Automatic Expiration: All offers and requests automatically expire and are deleted from our database 60 days after creation
- User Management: Users can delete or deactivate their offers/requests at any time through secure management links
- Management Access: Management tokens remain valid for the lifetime of the offer/request until deletion
- Safety Reports: Posted and moderated within the Facebook group and subject to Facebook’s rules and retention. We do not remove or retain Facebook posts; disputes should be raised in-group or via email.
5.5 No Guarantee
We do not guarantee the accuracy of safety reports and are not liable for decisions made based on such reports.
We collect and process personal information in accordance with our Privacy Policy and South Africa's Protection of Personal Information Act (POPIA). By using our Platform, you consent to such collection and processing as described in our Privacy Policy.
7.1 Content Management
- Monitor user-generated content
- Remove content that violates these Terms
- Suspend or terminate user accounts for violations
- Investigate reported violations
7.2 Platform Availability
- Temporarily suspend the Platform for maintenance
- Modify or discontinue features
- Restrict access in certain circumstances
8.1 Transport Law Compliance
Legal Framework
Users must ensure their activities comply with South African transport laws. The platform is designed for informal lift-sharing that does not constitute commercial transport requiring permits under the National Land Transport Act, 2009.
User Responsibilities:
- Drivers: Ensure lift-sharing remains informal cost-sharing, not commercial "for reward" transport
- All Users: Understand that systematic commercial transport may require operating licenses
- Provincial Compliance: Be aware of specific Provincial Regulatory Entity (PRE) guidelines in your area
- Legal Advice: Consult transport law specialists if unsure about compliance requirements
8.2 Dispute Resolution
These Terms are governed by South African law. Any disputes will be resolved through South African courts, with jurisdiction in the province where our business is registered.
We may update these Terms from time to time. Changes will be posted on our Platform with the updated date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
By using FindALiftClub, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
